Terms & Conditions
These terms apply to every quote, contract and installation we carry out. Please read them before signing off a quote.

- Written quotations are valid for 30 days from the quote date unless we say otherwise in writing.
- Quotations are based on the brief and site information provided. If the scope, finishes, hardware availability or site conditions change materially, we will issue a written variation before proceeding.
- All prices are stated excluding VAT unless explicitly marked "incl. VAT". VAT is added at the prevailing rate.
- Configurator prices are indicative. The binding figure is the written quotation issued after a site visit.
3. Payment terms
Unless agreed otherwise in writing, our standard payment schedule is:
- 30% deposit on order confirmation (this secures hardware and your install slot).
- 40% on first-fix completion or hardware delivery to site.
- 30% on commissioning sign-off.
Payment terms are 14 days from invoice date. Late payments may attract statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 where applicable, plus reasonable recovery costs.
4. Cancellation and consumer rights
For consumer contracts entered into off-premises (e.g. agreed at a site visit), you have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, email us at sales@westgateps.co.uk within 14 days of the contract date.
If you ask us to start work during the 14-day period and then cancel, you must pay for the work and hardware procured up to the point of cancellation. After hardware is procured or bespoke programming has begun, those costs are non-refundable.
Outside the cancellation period, cancelling a confirmed order may incur deposit forfeiture and reasonable charges for hardware ordered and time committed.
5. Site access, CDM and Part P
- You agree to provide safe, reasonable site access during agreed working hours, with power and welfare facilities where these are not otherwise provided by the principal contractor.
- For projects falling within the Construction (Design and Management) Regulations 2015 (CDM), we will act as a contractor and follow the principal contractor / principal designer's plans. On smaller domestic projects we adopt the duties of a contractor under CDM as appropriate.
- All electrical installation work in dwellings is notified under Part P of the Building Regulations via a registered Competent Person scheme.
- You are responsible for ensuring any structural, fabric or planning consents (including listed building or conservation-area approvals) are in place before our work starts.
6. Variations and additional work
Any change to the agreed scope (extra rooms, additional hardware, finish changes, scope creep) will be priced and confirmed in writing before being carried out. Verbal instructions on site will be followed up with a written variation as soon as practicable.
7. Warranty
- 12 months on Westgate's installation, programming and labour from the date of commissioning sign-off.
- 24 months Loxone manufacturer warranty on Loxone hardware (Miniservers, Tree extensions, Touch panels, etc.) from the date of installation.
- The warranty covers defects in workmanship and materials. It does not cover damage caused by misuse, third-party modifications, power surges outside Loxone-rated parameters, water ingress through faults outside our scope, or consumables (lamps, batteries, etc.).
- Warranty claims must be reported promptly. We may, at our discretion, repair, replace or refund the affected item or labour.
- An optional annual Care plan can be purchased to cover labour and remote support beyond Year 1.
8. Liability
We carry £15m public liability public liability insurance. Subject to the law, our total liability under or in connection with a contract is limited to the price you paid us under that contract. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
We are not liable for indirect or consequential losses, including loss of business opportunity, data, or anticipated savings.
9. Title and risk
Risk in goods passes to you on delivery to site. Title passes to you only when we have received cleared payment in full. Until then, supplied goods remain Westgate's property.
10. Disputes

11. Governing law and jurisdiction
These Terms and any contract made under them are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute, except where a non-business consumer's statutory rights provide otherwise.
12. Changes
We may update these Terms from time to time. The version that applies to your contract is the version in force on the date the contract is signed. Material changes will be highlighted at the top of the page.
